This Affiliate Program Terms & Conditions Agreement (“Agreement”) governs participation in the affiliate program (“Program”) operated by Gold Standard Research, LLC, a Wyoming limited liability company (“Company,” “we,” “our,” or “us”).
By clicking “I Agree,” submitting an application, or participating in the Program, you (“Affiliate,” “you,” or “your”) agree to be bound by the terms of this Agreement in full. If you do not agree to all terms, do not apply or participate in the Program.
1. Program Overview
The Program allows approved Affiliates to promote Company products and receive commissions on qualifying sales, subject to the terms set forth herein.
2. Eligibility and Enrollment
- You must be at least 18 years of age and legally authorized to enter into binding contracts.
- The Company reserves the right to approve or reject any application at its sole discretion.
3. Legal Compliance Requirements
- All Company products are sold strictly for laboratory research purposes only.
- Products are not intended for human consumption, injection, ingestion, topical use, therapeutic use, or any form of medical application.
- You must include the Company’s full disclaimer in all promotional materials.
- No medical, therapeutic, or performance claims may be made unless expressly approved in writing.
- You are solely responsible for complying with all applicable FDA, FTC, and state laws.
4. Required Disclaimer
“All products from Gold Standard Research, LLC are sold for laboratory research use only. Not for human consumption. These statements have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.”
5. Permitted and Prohibited Marketing Practices
Permitted:
- Use of official Company-approved product images and descriptions.
- Disclosure of affiliate relationships in accordance with FTC guidelines.
- Accurate representation of Company products.
Prohibited:
- Stating or implying products are for human use.
- Making health, performance, or therapeutic claims.
- Referencing medical conditions or health outcomes.
- Using “before and after” images or unapproved testimonials.
- Creating or distributing unapproved scientific content.
6. Independent Contractor Status
You are an independent contractor, not an employee, agent, or representative of the Company. You may not bind the Company to any obligations.
7. Intellectual Property
All Company trademarks, product names, and content remain Company property. Unauthorized modification or use is prohibited.
8. Commission Structure
Commission terms will be communicated separately. The Company may withhold commissions on non-compliant sales.
9. Indemnification
You agree to indemnify and hold harmless the Company against all legal claims, costs, and damages arising from your breach, unlawful conduct, or false marketing claims.
10. Termination
The Company may terminate your participation at any time. All commissions from prohibited conduct will be forfeited. You must cease all use of Company materials upon termination.
11. Limitation of Liability
The Company is not liable for indirect or consequential damages related to this Agreement.
12. Governing Law
This Agreement is governed by the laws of the State of Wyoming.
13. Modifications
The Company reserves the right to modify these terms. Continued participation constitutes acceptance of the changes.
14. Entire Agreement
This Agreement supersedes all prior understandings related to the Affiliate Program.
